Terms of Service – Voice-Fy

1. ACCEPTANCE OF TERMS

These Terms of Service (“Terms”) govern your use of Voice-fy.com’s voice over IP and communication services (“Services”). By creating an account or using our Services, you agree to be legally bound by these Terms.

If you do not agree to these Terms, do not use our Services.

Voice-fy.com (“Company,” “we,” “us,” “our”) reserves the right to suspend or terminate accounts and pursue legal action for violations of these Terms.

2. ACCOUNT REGISTRATION

2.1 Eligibility

Services are available only to individuals who:

Are at least 18 years of age (or legal age in their jurisdiction)
Have legal capacity to enter into binding contracts
Will use Services for lawful purposes only

2.2 Account Security

You are responsible for:

Maintaining confidentiality of login credentials
All activity under your account, whether authorized or unauthorized
Immediately notifying us of suspected unauthorized access at [email protected]
Enabling two-factor authentication (strongly recommended)

2.3 Account Information

You must provide accurate, current, and complete information during registration and maintain the accuracy of this information throughout your use of Services.

3. LEGAL USE REQUIREMENT

3.1 Lawful Purposes Only

YOU AGREE TO USE VOICE-FY.COM SERVICES EXCLUSIVELY FOR LAWFUL PURPOSES. You must comply with all applicable local, state, national, and international laws and regulations.

3.2 Prohibited Activities

You may NOT use our Services for:

Illegal Activities: Any activity that violates criminal or civil laws
Fraud: Scams, phishing, impersonation, or deceptive practices
Harassment: Threatening, abusive, or harassing communications
Spam/SPIT: Unsolicited bulk communications (voice or text), including spam over Internet telephony
Unauthorized Access: Hacking, unauthorized system access, or security breaches
Child Exploitation: Any content involving minors in inappropriate contexts
Terrorism: Material support or communications related to terrorist activities
Drug Trafficking: Facilitating illegal drug sales or distribution
Weapons Trafficking: Illegal weapons sales or distribution
Human Trafficking: Any involvement in human trafficking or exploitation
Copyright Infringement: Unauthorized distribution of copyrighted materials
Identity Theft: Stealing or using another person’s identity
Financial Crimes: Money laundering, wire fraud, or other financial crimes
Extortion or Blackmail: Threatening communications for gain
Illegal Robocalls: Automated calling campaigns in violation of applicable laws
Malicious Caller ID Spoofing: Falsifying caller ID for fraudulent or harmful purposes
Telemarketing Violations: Violations of Do Not Call registries or telemarketing laws
System Interference: Attempts to damage, disable, or interfere with our Services or systems
Malware Distribution: Distributing viruses, malware, or other harmful code
Any other illegal activity under applicable law

3.3 Caller ID Requirements

You must configure Caller ID to accurately represent your identity. You may not falsely assume the identity of another person or entity.

3.4 Monitoring and Enforcement

While we do not actively monitor the content of communications, we reserve the right to:

Investigate suspected violations
Suspend or terminate accounts immediately upon reasonable suspicion of illegal activity
Report illegal activity to law enforcement authorities
Cooperate fully with legal investigations and subpoenas
Preserve evidence of violations
Take any other action we deem necessary to protect our Services and comply with law

4. NO LIABILITY FOR CUSTOMER MISUSE

4.1 Customer Responsibility

YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR YOUR USE OF THE SERVICES. You acknowledge and agree that:

Voice-fy.com is a telecommunications service provider only
We do not control, direct, monitor, or have knowledge of the specific content of your communications
We are a neutral conduit for your communications
We are not responsible for how you or others use the Services
You bear complete legal responsibility for your actions and use of Services
You are responsible for all persons who access Services through your account

4.2 Complete Limitation of Liability for Illegal Use

VOICE-FY.COM SHALL NOT BE HELD LIABLE, ACCOUNTABLE, OR RESPONSIBLE FOR:

Any illegal, fraudulent, criminal, or harmful activities conducted using our Services
Customer violations of any law, regulation, or third-party rights
The content, nature, or legality of customer communications
Actions of persons who gain access (authorized or unauthorized) to your account
Misuse of Services by you or anyone using your account or credentials
Any damages, claims, losses, penalties, fines, or liabilities arising from your illegal use of Services
Any consequences, civil or criminal, resulting from customer activities

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL LIABILITY, RESPONSIBILITY, AND ACCOUNTABILITY FOR ANY AND ALL CUSTOMER MISUSE OF SERVICES, WHETHER SUCH MISUSE IS INTENTIONAL, NEGLIGENT, RECKLESS, OR ACCIDENTAL.

WE ARE NOT LIABLE FOR THE ACTIONS OF OUR CUSTOMERS. EACH CUSTOMER IS AN INDEPENDENT USER OF OUR SERVICES AND IS SOLELY RESPONSIBLE FOR THEIR OWN CONDUCT.

4.3 Full Indemnification

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD COMPLETELY HARMLESS VOICE-FY.COM, ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, PARTNERS, AND SERVICE PROVIDERS FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, ACTIONS, DAMAGES, LIABILITIES, COSTS, LOSSES, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS’ FEES, COURT COSTS, AND EXPERT FEES) ARISING FROM OR RELATED TO:

Your use or misuse of the Services
Your violation of these Terms
Your violation of any local, state, federal, or international law or regulation
Your violation of any third-party rights (including privacy, intellectual property, or contractual rights)
Any content you transmit, upload, or communicate through the Services
Any fraudulent, illegal, harmful, or unauthorized activity associated with your account
Any claims by law enforcement or regulatory agencies related to your use of Services
Any fines, penalties, or sanctions imposed due to your conduct

THIS INDEMNIFICATION OBLIGATION IS UNLIMITED IN SCOPE AND AMOUNT, SURVIVES TERMINATION OF YOUR ACCOUNT AND THESE TERMS, AND APPLIES EVEN IF VOICE-FY.COM IS ALLEGED TO HAVE CONTRIBUTED TO THE CLAIM.

5. LEGAL COOPERATION AND DISCLOSURE

5.1 Law Enforcement Cooperation

We will cooperate fully and immediately with law enforcement agencies and regulatory authorities. We comply with:

Valid subpoenas and court orders
Search warrants and judicial orders
National Security Letters
Emergency disclosure requests
Other lawful requests for information
Legal preservation and hold requirements

5.2 Voluntary Disclosure

We reserve the right to voluntarily disclose customer information, communications metadata, call records, and usage data when:

Required or requested by law
Necessary to comply with legal process
We believe in good faith that disclosure is necessary to protect our rights, property, or safety
We believe in good faith that disclosure is necessary to prevent harm, fraud, or illegal activity
We believe disclosure will assist in investigating or prosecuting illegal activity
Responding to emergency situations
Protecting the security and integrity of our Services

5.3 No Notice Requirement

We are not required to notify you before or after disclosing your information to authorities, and may be legally prohibited from doing so.

6. RATES AND BILLING

6.1 Service Rates

Current rates are published at voice-fy.com/pricing and may change at any time. You are responsible for reviewing applicable rates before using Services.

6.2 Account Balance

You are responsible for maintaining adequate account balance. Services may be suspended if balance is insufficient.

6.3 Payment

You agree to pay all charges incurred under your account. Payment methods and billing procedures are described on our website.

6.4 Billing Increments

Calls are billed according to the increments published at voice-fy.com/pricing, typically in 6-second increments with a minimum charge.

7. SERVICE TERMS AND WARRANTIES

7.1 “AS IS” Service

SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

Services will be uninterrupted, timely, secure, or error-free
Results obtained from Services will be accurate or reliable
Quality of Services will meet your expectations
Any errors in Services will be corrected
Services will be available in all locations or compatible with all devices

7.2 Internet and Technology Limitations

You acknowledge that:

VoIP services depend on Internet connectivity, power, and compatible equipment
Packet loss, latency, and other technical issues may affect service quality
Third parties may intercept or eavesdrop on communications
We have no control over Internet service providers or network infrastructure
Service quality varies based on location, equipment, and network conditions

7.3 Service Modifications and Interruptions

We may:

Modify, suspend, or discontinue any aspect of Services at any time without notice
Perform maintenance that temporarily interrupts service
Change features, functionality, or availability
Impose usage limits or restrictions

7.4 Not a Primary Service

Services should not be your sole telecommunications provider. You should maintain alternate means of communication, especially for emergency situations.

8. EMERGENCY SERVICES (911/E911)

8.1 Critical Differences from Traditional Phone Service

VOIP EMERGENCY SERVICES DIFFER SIGNIFICANTLY FROM TRADITIONAL TELEPHONE SERVICE. YOU MUST UNDERSTAND THESE CRITICAL LIMITATIONS:

8.2 Limitations of Emergency Services

Location Information: Your physical location may not be automatically transmitted to emergency dispatchers. You must verbally provide your exact location.
Service Dependencies: Emergency calls require active power, functioning Internet connectivity, and properly configured equipment. Service outages will prevent emergency calls.
Call Completion: We cannot and do not guarantee emergency calls will connect or complete.
Routing Delays: Emergency calls may experience routing delays or failures.
Address Accuracy: Emergency services depend on the accuracy of the address you register. You must keep this information current.

8.3 Required Configuration

For emergency services to function:

You must register a valid physical address in your account
Your outbound Caller ID must match your emergency-enabled number
You must immediately update your address if you relocate
Your equipment must be properly configured

8.4 Testing

Test your emergency services configuration regularly. Do NOT dial 911 for testing. Use our test number if available, or contact [email protected] for testing guidance.

8.5 Regulatory Requirements

Depending on your jurisdiction, you may be required to:

Activate emergency services on at least one number
Ensure all users can dial emergency services without prefixes
Notify users of emergency service limitations
Maintain alternate means of accessing emergency services

8.6 Complete Liability Waiver for Emergency Services

YOU EXPRESSLY ACKNOWLEDGE, UNDERSTAND, AND ACCEPT ALL RISKS AND LIMITATIONS OF VOIP EMERGENCY SERVICES.

VOICE-FY.COM, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

Failed, incomplete, delayed, or misdirected emergency calls
Inability to access emergency services due to service outages, power loss, or Internet disruption
Inaccurate, incomplete, or outdated location information
Actions or inactions of emergency service providers (PSAPs)
Quality or timeliness of emergency response
Any injury, death, or property damage resulting from emergency service limitations
Your failure to maintain alternate means of accessing emergency services

YOU RELEASE AND HOLD HARMLESS VOICE-FY.COM FROM ANY AND ALL CLAIMS, LIABILITIES, AND DAMAGES RELATED TO EMERGENCY SERVICES.

IF YOU ARE NOT COMFORTABLE WITH THESE LIMITATIONS, YOU MUST NOT RELY ON VOICE-FY.COM FOR EMERGENCY COMMUNICATIONS AND MUST MAINTAIN ALTERNATE MEANS OF CONTACTING EMERGENCY SERVICES (SUCH AS A TRADITIONAL TELEPHONE LINE OR MOBILE PHONE).

8.7 Emergency Services Fees

Emergency service activation may incur setup and monthly regulatory fees as published at voice-fy.com/pricing. These fees are non-refundable.

9. PRIVACY AND DATA

9.1 Privacy Policy

Your use of Services is governed by our Privacy Policy at voice-fy.com/privacy, which is incorporated into these Terms by reference.

9.2 Data Collection and Use

We collect, use, store, and may disclose data as described in our Privacy Policy and these Terms, including for:

Service provision and billing
Fraud prevention and security
Legal compliance and cooperation with authorities
Service improvement and analytics

9.3 Communications Consent

By creating an account, you consent to receive communications from us via email, phone, SMS, or mail for:

Account notifications and security alerts
Billing and payment information
Service updates and changes
Legal notices
Promotional offers (you may opt out of marketing communications)

9.4 Third-Party Service Providers

We may use third-party service providers to deliver Services. Your data may be processed, transmitted, or stored by these providers.

10. INTELLECTUAL PROPERTY

10.1 Ownership

All Services, software, website content, documentation, logos, trademarks, and materials remain the exclusive property of Voice-fy.com. You receive a limited, non-exclusive, non-transferable license to use Services in accordance with these Terms. No ownership rights are transferred.

10.2 Restrictions

You may not:

Copy, modify, or create derivative works of our Services or software
Reverse engineer, decompile, or disassemble our Services
Remove or alter proprietary notices
Use our trademarks without written permission
Frame or mirror any part of our website

10.3 Customer Content

You retain ownership of content you transmit through Services, but grant us a license to transmit, route, and store such content as necessary to provide Services.

10.4 Feedback

Any feedback, suggestions, or ideas you provide become our exclusive property. You assign all rights to such feedback and waive any claims related to it.

11. ACCOUNT TERMINATION

11.1 Termination by Voice-fy.com

We may immediately suspend or terminate your account, without notice or refund, if:

You violate these Terms
You engage in illegal activity or activity we reasonably believe is illegal
Your account poses security or fraud risks
Required by law or law enforcement
We discontinue Services
At our sole discretion for any reason

11.2 Termination by Customer

You may close your account at any time by contacting [email protected]. Refund eligibility, if any, will be determined according to our refund policy.

11.3 Effect of Termination

Upon termination:

Your right to use Services immediately ceases
We may delete your data and account information
You remain liable for all charges incurred before termination
Sections of these Terms that by their nature should survive (including indemnification, liability limitations, and dispute resolution) continue to apply

11.4 No Refunds for Violations

Accounts terminated for violations of these Terms, illegal activity, or fraudulent conduct forfeit all account balances without refund.

12. LIMITATION OF LIABILITY

12.1 Maximum Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOICE-FY.COM’S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO SERVICES OR THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU PAID TO VOICE-FY.COM IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

12.2 Exclusion of Consequential Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOICE-FY.COM SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, exemplary, or punitive damages
Lost profits, revenues, or business opportunities
Loss of data or information
Loss of goodwill or reputation
Business interruption
Cost of substitute services
Any other indirect or consequential losses

THIS EXCLUSION APPLIES REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER VOICE-FY.COM WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF WHETHER ARISING IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.

12.3 No Liability for Third Parties

We are not liable for:

Actions or omissions of third-party service providers, carriers, or networks
Equipment failures or compatibility issues
Internet service provider failures or disruptions
Actions of other users of Services
Third-party content or services accessed through our Services

13. DISPUTE RESOLUTION

13.1 Governing Law

These Terms are governed by the laws of [your jurisdiction], without regard to conflicts of law principles.

13.2 Jurisdiction and Venue

Any disputes arising from these Terms or Services shall be resolved in the courts of [your jurisdiction]. You consent to the exclusive jurisdiction and venue of these courts.

13.4 Waiver of Class Actions

YOU AND VOICE-FY.COM AGREE THAT ANY PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS AGAINST VOICE-FY.COM.

13.5 Time Limitation on Claims

Any claim arising from these Terms or Services must be filed within one (1) year after the claim arises, or it is permanently barred.

14. GENERAL PROVISIONS

14.1 Entire Agreement

These Terms, along with our Privacy Policy at voice-fy.com/privacy and any other policies referenced herein, constitute the entire agreement between you and Voice-fy.com regarding Services and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations under these Terms at any time with notice to you.

14.5 Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, governmental actions, Internet or telecommunications failures, or equipment failures.

14.6 Notices

Notices to you may be sent to the email address associated with your account and are deemed received 24 hours after sending. Notices to us should be sent to [email protected].

14.7 Amendments

We reserve the right to modify these Terms at any time. Updated Terms will be posted at voice-fy.com/tos with the effective date. We will notify you of material changes via email or prominent website notice. Your continued use of Services after changes become effective constitutes acceptance of the modified Terms.

14.8 Language

These Terms are drafted in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.

14.9 Headings

Section headings are for convenience only and do not affect interpretation of these Terms.

14.10 Independent Contractors

Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Voice-fy.com.

BY CREATING AN ACCOUNT, ACCESSING, OR USING VOICE-FY.COM SERVICES, YOU ACKNOWLEDGE THAT:

You have read, understood, and agree to be bound by these Terms of Service
You will use Services exclusively for lawful purposes
You accept complete responsibility for your use of Services
You understand that Voice-fy.com bears no liability or accountability for your illegal or improper use of Services
You agree to indemnify and hold harmless Voice-fy.com from any claims arising from your use of Services
You understand the limitations of VoIP emergency services and accept all associated risks
You waive any claims against Voice-fy.com related to service quality, availability, or your use of Services
